The Judicial Review saw us represented by a committee member of Keep Us Rural, Joel Williams. He appeared as a “Litigant in Person” to save costs whilst 2 barristers represented the developer and Newport City Council; Lord Justice Dove found in our favour on two points and went against Keep Us Rural on a further two points. He further decided that no costs would be levied on us.
He then dismissed ground 4 but ruled that Newport City Council had made an error of law regarding ground 1. Unfortunately he then used his discretion on ground 1 and decided not to quash the decision to allow planning permission for the solar farm.
We have since applied to The Court of Appeal for permission to challenge this decision.
